COVID-19 – The Gradual
Lifting of Travel Restrictions新冠肺炎疫情 – 旅行禁令的逐步解除 This is a short note on the gradual lifting of travel bans as the COVID-19 quarantine continues. The experience of domestic control of quarantine measures can be utilized to allow legitimate travels of natural persons to and from China. Parties travelling to China for arbitration and other matters should continue to be encouraged. The bilateral free trade agreements should, on prior basis, be observed in gradually lifting the travel bans and attracting natural talents from other signatory countries. Maintaining the open door policy for natural persons in the COVID-19 era is strategically necessary to keep up with construction of an internationalized open economy in the country. 自2019年末,新型冠状病毒悄然爆发并逐渐蔓延至全球各大洲。随后,包括意大利、美国和澳大利亚在内的许多国家相继发布了“旅行禁令”。2020年3月26日,中国对外发布了“关于暂时停止持有效中国签证、居留许可的外国人入境的公告”(以下简称“公告”)。 该入境限制已于2020年3月28日0时生效,旨在减少跨境人员流动,降低新冠病毒的传播风险。与此同时,服务贸易中自然人流动形式的经贸往来受到直接冲击,包括本来来华进行争议解决和开庭、出席庭审活动的当事人,因为旅行限制,不能来华参加庭审。 是否以及如何逐步解除旅行禁令?本文旨在讨论国际法项下的应对措施。
