法律英语研习山东之行
Thanks to the legal foreign language study group of Shandong High People’s Court, a study workshop was conducted at the court on March 28, 2019. Many judges, lawyers, arbitrators and other professionals attended the workshop in their busy schedules of daily work.
感谢山东省高级人民法院法律外语学习小组于2019年3月28日在该院举办的一次学习交流活动。许多法官，律师， 仲裁员和其他专业人士在繁忙的日常工作日程中参加了此次研讨会。
Lectured by Jerry Zhang, PhD, CIETAC and HKIAC Arbitrator, the group discussed some of the key writing rules for analytical and persuasive writing. Some of the rules for interpretation of statutes from common law jurisdictions were introduced for the participants. The group briefly touched on the concept of law and justice in the literature and studied some key provisions of the newly passed Foreign Investment Law of the PRC （FIL）.
此次研讨会由法学博士、贸仲和香港国际仲裁中心仲裁员张玉林先生主讲，讨论了一些关于分析性和说服性写作的关键写作规则。并向与会者介绍了普通法系的一些法律解释规则。研习小组从法律文献角度简要分析了法律和正义的概念，并研习了新颁布的《中华人民共和国外商投资法》(《外商投资法》)的一些关键条款。
The participants focused on understanding some of the definitions under the FIL, understanding the differences between policies and laws, and understanding the new trend of interpretation in favor of arbitration agreements in China. The ordinary meaning of words used in the legislation, the context in which the words are used, the intent and goals of the legislation, are highlighted in the course of the study.
与会者重点了解了《外商投资法》中的一些定义，政策和法律的差异，并了解了中国支持仲裁协议之解释的新趋势。 在研习过程中，突出强调了立法中所使用词汇的普通释义，词汇的上下文语境，立法的意图和目的。
As debate and dialogue help generate thoughts in the thinking process, the group saw its participants actively engaged in some interesting topics under the FIL, including the definition such as “within the territory of China ” from legal perspective, the concept and challenges of “equal treatment” in Chinese market. Clustered among the questions is the thread of justice and harmony in legal theory regarding common pursuit in different legal cultures.
由于辩论和对话不断激励新的思考，与会者积极参与《外商投资法》下一些有趣的话题讨论，包括从法律层面理解“中国境内”的定义，中国市场中“平等待遇”的概念和挑战。 贯穿问题的主线是不同法律文化所共同追求的正义与和谐的法律理念。
Participants found themselves presenting their thoughts and arguments in clear and concise language. Some new ideas were introduced for discussion purposes. It is very encouraging to learn that the workshop organized by the Shandong High People's Court attracted a wide range of internationally experienced and educated professionals from all cross the capital city of Jinan to come together, study together and interact with each other. Through group study, they shared their experiences and mutually learned new perspectives of the latest legal development in the fields of foreign investment and dispute resolution in the country.
与会者在表达他们的想法和论点时，已经在使用简明扼要的语言。 为讨论目的引入了一些新想法。 令人备受鼓舞的是，山东省高级人民法院举办的这次研习会吸引了来自省会济南的国际经验丰富，受过良好教育的专业人士齐聚一堂，共同学习，互相交流。 通过小组学习，他们分享了经验，并相互学习了中国在外商投资和争议解决领域的最新法律发展的新观点。
As night fell quickly with spring rain, participants felt grateful to Shandong High People's Court for its open attitude in organizing this foreign language study workshop, and the full support from CIETAC Shandong Sub-Commission for the foreign language study activity. Many participants expressed the hope to meet some time again in the future for group study.
夜幕随着春雨很快降临，与会者感谢山东省高级人民法院开放举办法律外语学习交流活动，以及贸仲山东分会对法律外语学习小组举办的这次活动的全力支持。许多与会者表示希望将来再次见面进行交流学习。
